FAQ

What should I do after truck accident?

Most important is seeking proper and necessary medical treatment for your injuries. Many people try to “tough it out” and only end up prolonging their injuries by not seeking prompt medical treatment. Additionally, understand that emergency rooms are designed to handle emergency situations and not ongoing diagnosis and treatment. Many people get discharged from the emergency room and mistakenly believe they are fine only to find out later they have real serious issues.  Follow-up with the hospital reccomendations and referrals and follow your doctors orders. Seek treatment from quality doctors you trust.

Document the scene

If you are able, take photographs with your cell phone of the position of the vehicles and damage caused in the truck accident. Make sure you have the information on the truck driver and keep the officer’s card or other contact information. Never agree to waive an accident report if you feel you are not at fault.

Do not give a statement to the truck driver’s insurance company

After a serious truck accident one of the first things an insurance company will do is send an adjuster out to take a recorded statement from you, the victim. No good can come from giving such statement and some less than scrupulous adjusters use the opportunity to defend the case and trap and unsuspecting victim with trick questions instead of  looking for impormation to fairly settle the case. Always speak with a reputable personal injury lawyer with a track record of success in Texas truck accident lawsuits before giving any statements to an insurance adjuster or lawyer for the trucking company.

If you are seriously injured

Many times the condition of the tractor-trailer is a factor in a truck accident case and sometimes it is important to preserve the truck before it is put back in service. Despite assurances that you may receive from insurance companies that they are “responsible” and will “take care of you” the simple fact of the matter is insurance companies are in the business of paying as little as it possibly can on any claim. Serious injury cases will not receive the same consideration or even market value damages without a serious lawyer involved regardless of what the insurance compnay will say. There is a reason why the insurance company does not want you to hire a lawyer.
